The Prevention Of Cybercrime Through The Jurisprudence Of Blocking The Means (sadd Al-dharā’iʿ) And The Precautionary Principle In Law: A Foundational And Foresight Study

Abstract
This study addresses a preventive approach to cybercrime by employing the jurisprudence of blocking the means (*sadd al-dharā’iʿ*) as a Sharia-based mechanism aimed at preventing actions that may lead to prohibited outcomes before they occur. It also incorporates the precautionary principle in law, which focuses on adopting proactive measures to avoid potential risks. The research highlights the points of convergence between these two approaches, as both are grounded in preventing harm and safeguarding interests, particularly within a digital environment characterized by complexity and rapid evolution. It further seeks to establish the theoretical foundations of this integration between the jurisprudential and legal frameworks, while exploring prospects for developing effective preventive policies to reduce cybercrime. The study emphasizes the importance of adopting flexible legislation and precautionary measures that enhance cybersecurity, alongside promoting digital awareness, in order to achieve a balance between protecting society and ensuring the responsible and disciplined use of technology. ملخص: يتناول هذا الموضوع مقاربة وقائية للجريمة المعلوماتية من خلال توظيف فقه سدّ الذرائع بوصفه آلية شرعية تهدف إلى منع الوسائل المفضية إلى الحرام قبل وقوعه، إلى جانب مبدأ الحيطة في القانون الذي يركز على اتخاذ تدابير استباقية لتفادي المخاطر المحتملة، ويبرز البحث أوجه التقاطع بين هذين المنهجين في كونهما يقومان على درء المفاسد وحماية المصالح، خاصة في بيئة رقمية تتسم بالتعقيد والتطور السريع. كما يسعى إلى تأصيل هذا التكامل بين المرجعيتين الفقهية والقانونية، مع استشراف آفاق تطوير سياسات وقائية فعالة تحدّ من الجرائم المعلوماتية، ويؤكد على أهمية تبني تشريعات مرنة وإجراءات احترازية تعزز الأمن السيبراني، إلى جانب نشر الوعي الرقمي، بما يحقق توازنًا بين حماية المجتمع وضمان حرية استخدام التكنولوجيا في إطار من المسؤولية والانضباط. الكلمات المفتاحية: الجريمة المعلوماتية؛ سدّ الذرائع؛ مبدأ الحيطة؛ الوقاية القانونية؛ الفقه الإسلامي؛ الأمن الرقمي؛ السياسة الجنائية.
