المواجهة الجنائية لجريمة التنمر الإلكتروني دراسة مقارنة

الملخص
ملخص البحث: هل أنت ضحية للتنمر، هل يلحق المحتوى المنشور على الإنترنت ضررًا بأطفالك، هذه الأسئلة تثير نقاشات عدة حول التنمر، فظاهرة التنمر التقليدي أو التقني معقدة ومتعددة الجوانب، يرجعها البعض لأسباب تتعلق بالتعليم والصحة والبيئة وطبيعة الفئة العمرية أطفال أو مراهقين أو البالغين، ورغم قدمها إلا أنها حتى وقت قريب لم تكن تحظى باهتمام الباحثين، إلا أن انتشار الأدوات التقنية الحديثة أظهرها بشكل يمثل اعتداء على المجتمع بشكل عام، مما ساعد على بروز المشكلة ومواجهتها تشريعيًا، ومن خلال هذا البحث نبين أِشكال التنمر التقليدية مثل التنمر الجسـمي واللفظي والنفسي والتنمر الجنسي والعرقي والمدرسي المضايقة وتشويه السمعة والإهانة وانتحال الهوية والخداع، وأِشكال التنمر التقني والتي تتمثل في سلوك التكرار في الهجوم، والاستبعاد، والمكالمات، والرسائل، والصور، ومقاطع الفيديو، والبريد الإلكتروني، كذلك يقع التنمر التقني من خلال غرف الدردشة عبر الويب وروابط الويب الخداعية، وموضوع التنمر بصورتيه تناولهما البحث من خلال استخدام المنهج التحليلي والوصفي مع استخدام المنهج المقارن، والبحث يهدف إلى بيان مفهوم التنمر بشقيه التقليدي والتقني، وأركان الجريمة ، وتوضيح حقوق من يتعرض للتنمر التقني وتعويضه عن الأذى النفسي، أو الجسدي الذي يعاني منه، عبر فرض العقوبات المناسبة للمتنمرين، ويركز البحث بشكل مباشر على أهمية مراقبة الأطفال على الإنترنت ووسائل التواصل الاجتماعي وملاحظة أي شيء غير عادي يؤثر عليهم، وكذلك ضرورة مواكبة القوانين للتطور الإلكتروني لمعاقبة مرتكبي جرائم التنمر. ومن أهم النتائج ضرورة توافر أركان خاصة لقيام جريمة التنمر، كما توصل البحث إلى أن التنمر جريمة معاقب عليها في القانون الفرنسي والمصري، إلا أنها تحتاج إلى التشديد في بعض الحالات، بالإضافة إلى ذلك أظهر البحث عدم تطرق المشرع العراقي لتجريم سلوك التنمر بنص خاص كما فعل كل من المشرع الفرنسي والمصري. Abstract: Are you a victim of bullying? Is online content harming your children? These questions spark numerous discussions about bullying. The phenomenon of traditional and cyberbullying is complex and multifaceted. Some attribute it to factors related to education, health, the environment, and the age group involved—children, adolescents, or adults. Despite its long history, bullying was largely ignored by researchers until recently. However, the proliferation of modern technology has brought it to the forefront as an assault on society as a whole, contributing to the problem's prominence and the need for legislative action. This research identifies traditional forms of bullying, such as physical, verbal, psychological, sexual, racial, and school bullying, as well as harassment, defamation, insults, identity theft, and deception. It also examines cyberbullying, which includes repeated attacks, exclusion, calls, messages, images, videos, and emails. Cyberbullying also occurs through online chat rooms and deceptive web links. The research utilizes analytical, descriptive, and comparative methodologies to address both forms of bullying. The research addresses both traditional and technological aspects of cyberbullying, the elements of the crime, and the rights of victims of cyberbullying, including compensation for psychological or physical harm suffered. It also emphasizes the need for appropriate penalties for bullies and focuses directly on the importance of monitoring children's online activity and social media use, observing any unusual behavior. Furthermore, the research highlights the necessity for laws to keep pace with technological advancements in order to punish perpetrators of cyberbullying. Among the key findings is the requirement for specific elements to constitute the crime of bullying. The research also reveals that bullying is a punishable offense under French and Egyptian law, although penalties may need to be increased in certain cases. Additionally, the research indicates that Iraqi legislation does not explicitly criminalize bullying, unlike its French and Egyptian counterparts.
