معالم القضاء العُماني في القرن الخامس الهجري

الملخص
يهدف هذا البحث إلى إبراز دور القضاء العماني في القرن الخامس الهجري، وإيضاح معالمه ببيان الوضع القضائي في هذا القرن وأشهر القضاة العمانيين، وأهم المؤلفات العلمية العمانية في القضاء، وأبرز الأحكام والمسائل القضائية الواردة فيها، مع تفصيل مواضيع القضاء ومسائله الواردة فيه، وتحليلها، لأجل إيضاح النهضة العلمية في كتابة أحكام القضاء والأحكام القضائية في هذا القرن. وقد اخترت المنهج الاستقرائي بتتبع أسماء أشهر الذين تولوا القضاء في القرن الخامس الهجري في عمان، وأبرز المؤلفات القضائية خلاله، والمنهج التحليلي بالنظر في نصوص المؤلفات الفقهية في أحكام القضاء ونوازله وتحليلها. Abstract: This research aims to highlight the role of the Omani judiciary in the fifth century AH, and to clarify its features by explaining the judicial situation in this century, the most famous Omani judges, the most important Omani scientific works on the judiciary, and the most prominent rulings and judicial issues contained therein, with a detailed explanation of the topics of the judiciary and the issues contained therein, and an analysis of them. To illustrate the scientific advancement in the writing of judicial rulings and judgments in this century, I have chosen the inductive method by tracing the names of the most prominent judges in Oman during the fifth century AH, and the most significant judicial works of that period, and the analytical method by examining and analyzing the texts of legal works on judicial rulings and their related issues.
