Given the rapid evolution of transactions and the changing circumstances in the economic sphere, most legislations, including the Algerian legislator, have sought to keep pace with this development. This has been achieved at the expense of the rules known in traditional criminal law. Thus, we find that the Algerian legislator, when regulating the economic aspect, stipulated special principles and provisions that deviate from the general rules in the Penal Code. Among these is the specificity at the level of the legal elements required for economic crime. We find a clear change in the features of the legal element, as well as the ambiguity of the material element of economic crime, in addition to the weakness of the moral element in some economic crimes.
