الملخص
ملخص: تهدف هذه الدراسة إلى الكشف عن الاستراتيجيات والآليات القانونية الكفيلة بحماية الطفل من جريمة الاستغلال الجنسي عبر الفضاء الإلكتروني. وقد تم في البداية تناول الإطار النظري للموضوع من خلال ضبط المفاهيم القانونية ذات الصلة، سواء على المستوى الوطني في ضوء القانون الجزائري أو على الصعيد الدولي، مع التطرق إلى أهم العوامل المفسرة لانتشار هذه الظاهرة. كما تم التعمق في دراسة الآليات القانونية المقررة لحماية الطفل باعتباره الضحية الأساسية لهذه الجريمة، وذلك بالرجوع إلى أحكام القانون 12-15 والتشريعات الدولية ذات الصلة. ولم يقتصر البحث على هذا الجانب، بل شمل أيضاً عرضاً لأنماط الجرائم التي تندرج ضمن الاستغلال الجنسي بوجه عام، إلى جانب العقوبات المقررة لمرتكبيها. وقد اختُتمت الدراسة بجملة من الاقتراحات العملية الرامية إلى الحد من هذه الظاهرة وتعزيز فعالية الحماية القانونية للأطفال. Abstract: This study aims to explore the strategies and legal mechanisms designed to protect children from the crime of sexual exploitation through cyberspace. It begins by addressing the theoretical framework of the subject, clarifying the relevant legal concepts at both the national level, within Algerian law, and the international level, while also identifying the main causes behind the spread of this phenomenon. The research further examines the legal mechanisms established to safeguard children as the primary victims of such crimes, with particular reference to Law 12-15 and relevant international conventions. In addition, the study outlines the different types of crimes that fall under sexual exploitation in general, as well as the sanctions imposed on perpetrators. Finally, it concludes with a set of practical recommendations aimed at limiting the spread of this crime and reinforcing the effectiveness of child protection measures.
