الملخص
تُعتبر بصمة الحمض النووي من أحدث الاكتشافات العلمية في مجال الأدلة الجنائية، وهي من أهم وسائل الإثبات العلمية التي كشفت عنها التطورات البيولوجية الحديثة، متفوقةً على غيرها من الأدلة الجنائية من حيث الدقة والموضوعية. وقد أقرت معظم التشريعات الوطنية والمؤتمرات الدولية والإقليمية بشرعيتها، كما أثبتت الأحكام القضائية أن نتائجها تُشكل أدلةً قاطعة في العديد من الجرائم، كالقتل والاغتصاب وغيرها. إلا أنه في بعض الحالات، عندما تُعثر على بصمات في مسرح الجريمة، فإنها تبقى مجرد افتراض. وقد أكد المشرع الجزائري هذا الاكتشاف بإصدار القانون 16-03 المتعلق باستخدام بصمة الحمض النووي في الإجراءات القانونية وتحديد هوية المفقودين أو مجهولي الهوية. وقد حسّن هذا الإجراء من خلال تقليل عدد المشتبه بهم مع ضمان احترام السلامة الجسدية والحق في الخصوصية. The DNA fingerprint is considered one of the latest scientific discoveries in the field of forensic evidence, and it is among the most important scientific methods of proof revealed by modern biological developments, surpassing other forensic evidence in terms of accuracy and objectivity. Most national legislations as well as international and regional conferences have recognized its legitimacy, and judicial rulings have demonstrated that its results constitute conclusive evidence in many crimes, such as murder, rape, and others. However, in some cases, when fingerprints are found at the crime scene, they remain merely an assumption. The Algerian legislator affirmed this discovery by issuing Law 16-03 concerning the use of DNA fingerprints in legal procedures and in identifying missing or unknown individuals. This measure has improved investigations by reducing the number of suspects while ensuring respect for physical integrity and the right to privacy.
