This study aims to shed light on one of the outcomes of the Fourth Industrial Revolution, namely smart contracts. This type of contract differs from both traditional and electronic contracts in terms of its concept, unique and distinctive characteristics—most notably, its automatic execution, meaning it requires no human intervention for its performance. This particular feature has created numerous legal challenges, both at the stage of contract formation and in the post-formation phase. It has become evident that the general rules governing the theory of contract do n do not align with smart contracts, particularly with respect to the element of consent or legal capacity, and even in the interpretation of such contracts in the event of a dispute between the contracting parties, given that they consist of encrypted codes that a judge cannot comprehend. Furthermore, the application of the doctrines of unforeseen circumstances and force majeure proves difficult, considering that smart contracts are self-executing in nature.
