Abstract
This study aims to analyze the reality of digital justice amid the ongoing digital transformation of judicial systems, with a focus on the extent to which the fundamental guarantees of a fair trial—as enshrined in international human rights instruments and national constitutions—are upheld. The study comes in the context of an increasingreliance on technologicaltools in judicial proceedings, raisinglegal and technical challenges that directly impact the essence of justice. تهدف هذه الدراسة إلى تحليل واقع العدالة الرقمية في ظل التحول الرقمي الذي يشهده قطاع القضاء، مع التركيز على مدى احترام وضمان المبادئ الأساسية للمحاكمة العادلة، كما هي مقررة في الاتفاقيات الدولية لحقوق الإنسان والدساتير الوطنية، وقد جاءت هذه الدراسة في سياق تزايد الاعتماد على الوسائل التكنولوجية في الإجراءات القضائية، وما يرافق ذلك من تحديات قانونية وتقنية تمس جوهر العدالة.
