1958. At the international level, the requirements for enforcing electronic arbitration awards have assumed increasing significance. In response to this development, UNCITRAL, through its 2025 Recommendations, undertook an examination of the issue and proposed solutions to the challenges posed by reliance on the New York Convention when determining the conditions for enforcing such awards. Within these Recommendations, UNCITRAL expressly referred to Article 4 of the New York Convention, which prescribes the requirements for enforcement, while introducing targeted modifications to address the distinctive features of electronic arbitration. These adjustments were grounded in the principle of functional equivalence, as articulated in the instruments of electronic commerce. The enforcement of electronic arbitration awards has acquired increasing significance at the international level. UNCITRAL, through its 2025 Recommendations, sought to address this issue by examining the challenges posed when reliance is placed on the 1958 New York Convention to determine enforcement requirements. However, the Recommendations did not introduce substantive innovations; instead, they reaffirmed Article 4 of the Convention and emphasized the necessity of adopting an expansive interpretation capable of accommodating the specific features of electronic arbitration. This study investigates the extent to which the 2025 Recommendations contribute to shaping the enforcement regime of electronic arbitral awards and to re-framing the traditional conditions established by the New York Convention.
