مفهوم الوقف وأهدافه: دراسة نموذجية للمغرب الأوسط في العصر الوسيط القرن(2ه-9ه)

الملخص
يعد الوقف أحد مقومات التعاون والتكافل الاجتماعي في المجتمعات الإسلامية، بما يحمله في طياته من مبادئ وقيم ونمط إسلامي متميز يعبر عن صيغ التقرب إلى الله سبحانه وتعالى، كما يعد مصدر تاريخي لبناء المجتمعات واعمار الأرض، كما أن له الفضل في بناء المؤسسات الدينية والتعليمية خاصة المساجد والزوايا والمدارس، وله وجود كبير في حياة المجتمع الإسلامي، وتستند مشروعية الوقف إلى الكتاب والسنة حيث جاء في قول الله تعالى:﴿ لَنْ تَنَالُوا الْبِرَّ حَتَّى تُنْفِقُوا مِمَّا تُحِبُّونَ﴾. سورة آل عمران الآية92 للوقف الدور الكبير والأثر الفعال في تعزيز الحياة الاجتماعية، وترسيخها على مدى القرون الماضية، ورغم ذلك فالوقف يعاني خطر الزوال لما يشهده من نهب وسلب من جهة، وقلة الاهتمام من جهة أخرى، إضافة إلى عوامل طبيعية وبشرية كثيرة منها نقص الحماية والوعي لدى أفراد المجتمع، كما أنها تشهد تهميشا خاصة في الآونة الأخيرة، ليتحول بذلك إلى تراث منسي يحتضر ولا تعرف قيمته الثمينة لدى الأجيال اللاحقة، ومنه نطرح الإشكالية التالية: ما هو الوقف وأهدافه في المغرب الأوسط في العصر الوسيط بين القرنين (2-9)ه ؟. Abstract The endowment is one of the components of cooperation and social solidarity in Islamic societies, as it carries within it principles, values, and a distinct Islamic style that expresses the forms of closeness to God Almighty. It is also considered a historical source for building societies and reconstructing the land. It is also credited with building religious and educational institutions, especially mosques and zawiyas. And schools, and it has a major presence in the life of the Islamic community, and the legitimacy of the endowment is based on the Qur’an and Sunnah, as it is stated in the words of God Almighty: “You will not attain righteousness until you spend of what you love” Surah Al Imran, verse 92. The endowment has a great role and effective impact in enhancing social life and consolidating it over the centuries. Despite this, the Waqf is suffering from the danger of disappearing due to the looting and dispossession it is witnessing on the one hand and the lack of interest on the other hand, in addition to many natural and human factors, including a lack of protection and awareness among members of society. It is also witnessing marginalization, especially in recent times, thus turning into a forgotten and dying heritage.
