عن التأطير القانوني للأسواق الرقمية

الملخص
ملخص: تعرف الأسواق تطورا كبيرا في السنوات الأخيرة خاصة بعد انتشار المنصات الرقمية والأنترنيت، الأمر الذي سمح بانتشار مختلف المنتجات من السلع والخدمات صاحبه ظهور أسواق من نوع خاص وهي الأسواق الرقمية. بهذا المعنى ظهرت شركات قوية في السوق سميت بالشركات الرقمية يختلف حجمها على حسب النشاط الممارس صاحبه ضرورة مواكبة مختلف التشريعات لتنظيم هذه الأسواق الرقمية. بهذا المعنى حاولت بعض التشريعات وبالخصوص التشريعات الأوروبية وضع نصوص لمحاولة ضبط الأسواق الرقمية من خلال اعتماد قاعدة وهي ضمان تكافؤ الفرص لجميع الشركات التي تنشط في الفضاء الرقمي من حيث ما يجب فعله وما لا يجب من حيث تصنيف الخدمات والمنتجات التي يقدمها برنامج حماية البوابة نفسه أعلى من الخدمات أو المنتجات المماثلة التي تقدمها جهات خارجية على منصة برنامج حماية البوابة أو عدم منح المستخدمين إمكانية إلغاء تثبيت أي برنامج أو تطبيق مثبت مسبقًا. الكلمات المفتاحية: الأسواق الرقمية، التشريعات، المشرع الجزائري، التنظيم Abstract : Markets have witnessed significant development in recent years, especially with the proliferation of digital platforms and the internet. This has allowed for the proliferation of various products and services, accompanied by the emergence of a special type of market: digital markets. In this sense, powerful companies, known as digital companies, have emerged in the market, varying in size depending on the activity they engage in. This has led to the need to keep pace with various legislations to regulate these digital markets. In this sense, some legislations, particularly European legislation, have attempted to establish provisions to regulate digital markets by adopting a rule that ensures equal opportunities for all companies operating in the digital space in terms of what should and should not be done, such as classifying the services and products offered by the Gatekeeper program itself above similar services or products offered by third parties on the Gatekeeper program platform, or prohibiting users from being able to uninstall any pre-installed software or application..
