الملخص
ملخّص البحث باللغة العربية: مزايا بدائل العقوبة السالبة للحرية قصيرة المدة إنّ العقوبة السالبة للحرية قصيرة المدة تتمثّل في حرمان المحكوم عليه من حريته لمدة لا تزيد عن سنة كاملة، وعزله في مكان محدّد بعيدا عن بيئته الطبيعية، وهذه العقوبة لها سلبيات كثيرة ومتعدّدة على مستوى الفرد، والأسرة والمجتمع، إذ هي طريق لتبادل الخبرات الإجرامية بين النزلاء في المؤسّسة العقابية، وسبب للتفكّك الأسري..، ونتيجة للآثار السلبية الكثيرة لها سعت العديد من الدول إلى الأخذ ببدائل لتحلّ محلها بشكل يضمن تأهيل الجاني، وعودته إلى رشده ليكون فردا صالحا في المجتمع، ولإيجابيات هذه البدائل على المستوى الفردي، والأسري، والاجتماعي سارع مختلف المشرّعين عبر العالم؛ الغربي والعربي إلى تبنّي هذه البدائل ما بين موسّع، ومضيّق، والمشرّع الجزائري من بين المضيّقين إذ لم يأخذ إلّا ببديلين اثنين، وهما؛ وقف التنفيذ البسيط، والعمل للنفع العام. الكلمات المفتاحية: مزايا، بدائل، العقوبة، السالبة، قصيرة. English Research Summary: Advantages of Alternatives to Short-Term Freedom Negative Punishment The short-term punishment for deprivation of liberty is to deprive the convicted person of his liberty for no more than a whole year, and to isolate him in a specific place away from his natural environment, and this punishment has many and many disadvantages at the level of the individual, family and society, as it is a way to exchange criminal experiences between inmates in the penal institution, and a cause of family disintegration. As a result of its many negative effects, many countries have sought alternatives to replace them in a way that ensures that the perpetrator is rehabilitated and returned to his senses to be a good member of society In order to positive these alternatives at the individual, family and social levels, various legislators around the world, Western and Arab, have been quick to adopt these alternatives between The Expanded, The Strait, and the Algerian legislator from between the two straits, taking only two alternatives: simple suspension of implementation and work for the public good Keywords: Advantages, Alternatives, Punishment, Negative, Short
