The will raises several jurisprudential issues when the testator and legatee have different religions. Generally, differing religions do not invalidate a will, but scholars debate if a Muslim can bequeath to a combatant or apostate. The Algerian legislator’s stance is broad, allowing for varied interpretations. Wills with foreign elements face challenges in private international law, notably conflicts in characterizations and laws. Determining the appropriate connecting factor for disputes is complex. The Algerian legislator treats wills as personal status, applying the testator’s nationality law at death for substantive conditions and the nationality law at the time of the bequest or the law where the will was made for formal conditions.
