Applicable Law And The Arbitrator's Role In International Commercial Arbitration

Authors : Chouchou Achour .

Abstract

International traders often opt for international commercial arbitration because of its numerous advantages. One key benefit is the parties’ ability to select the law governing the dispute. This may be the national law of a specific country, a set of international legal norms, or what is commonly referred to as international commercial law. The arbitrator plays a crucial role in interpreting the chosen law, assessing its relevance to the nature of the dispute, and determining which provisions are applicable. In the absence of a clear choice by the parties, the arbitrator may apply rules derived from either domestic or international legal systems, based on what is most appropriate for the case at hand.
