الحوكمة كآلية قانونية لترشيد إدارة الأوقاف في الجزائر طبقا للقانون 25-06

الملخص

يسعى هذا البحث إلى إبراز أهمية حوكمة الوقف ودورها في تحسين إدارة الأوقاف وضمان استدامتها، من خلال دراسة مدى تجسيد مبادئ الحوكمة في القانون الجزائري للأوقاف. وتنطلق الدراسة من إشكالية مفادها إلى أي حدّ يوفّر القانون الجزائري ضمانات كفيلة بتكريس مبادئ الحوكمة؟. وتهدف الدراسة إلى تحليل الإطار القانوني المنظم للوقف في الجزائر، وبيان آليات تطبيق مبادئ الشفافية والمساءلة والرقابة وحسن التسيير في إدارة الأموال الوقفية، إضافة إلى الوقوف على أوجه القصور في النصوص القانونية المعمول بها. واقتراح سبل تدعيم الإطار القانوني بما يحقق فعالية أكبر للوقف في خدمة المقاصد الشرعية والتنمية المستدامة. This research seeks to highlight the importance of endowment governance and its role in improving the management of Endowments and ensuring their sustainability, by studying the extent to which the principles of governance are embodied in the Algerian law of Endowments. The study proceeds from the problematic question: to what extent does Algerian law provide guarantees to enshrine the principles of governance. The study aims to analyze the legal framework governing the endowment in Algeria, and to indicate the mechanisms of applying the principles of transparency, accountability, control and good management in the management of endowment funds, in addition to identifying shortcomings in the legal texts in force. Propose ways to strengthen the legal framework in order to achieve greater effectiveness of waqf in the service of legitimate purposes and sustainable development.
