Abstract: In light of the rapid development the world is witnessing in the field of medicine and health sciences, many diseases have become less dangerous and threatening to human life thanks to advances in treatment and diagnostic methods. Scientific and medical experiments have played a pivotal role in expanding knowledge about the causes of diseases and ways to combat them. However, these experiments, despite their benefits, raise deep ethical and legal issues, as in some cases they may constitute a violation of the sanctity of the human body and the principle of its inviolability. The COVID-19 pandemic, which swept the world over the past two years, has strongly brought this issue to the forefront, especially given the inability of global health systems to develop an effective vaccine at the onset of the crisis. In this situation, there arose an urgent need to conduct medical trials on human subjects to develop effective vaccines and treatments, with the understanding that these trials may involve potential risks causing serious harm to the bodies of volunteers, and could affect the functioning of their vital organs or even threaten their lives. From this perspective, the importance of studying the legitimacy of scientific and medical experiments on humans emerges in light of national and international legislation, particularly within the framework of Algerian legislation, which has regulated this matter through Law No. 18-11 related to health and its promotion, alongside complementary laws, with the aim of finding a balance between the necessities of scientific research and the protection of human dignity and physical safety.
