ضوابط تجريم التمييز وخطاب الكراهية في ظل ممارسة الحق في حرية الرأي والتعبير

الملخص
إذا كان تجريم التمييز وخطاب الكراهية ضروريا لحفظ حقوق الغير والمحافظة على مبدأ المساواة في المجتمع، ومن ثم تماسكه واستمراره، فإنه ينبغي التنبيه إلى أن هذا التجريم إنما هو في مقابلة حق آخر أكثر تأكدا وأصالة، ومبدأ عظيم من المبادئ التي تقوم عليها المجتمعات الراقية، هو مبدأ حرية الرأي والتعبير. وعليه فإن تقييد هذا الحق في أي شكل من الأشكال ينبغي أن يكون تقييدا ضروريا، ومناسبا لطبيعته في أنه الحق الأصلي والمبدأ العام. فيستلزم الأمر-وفق هذه المقدمة- أن يحاط تجريم التمييز وخطاب الكراهية بمجموعة من الضوابط الضرورية، التي تجعل الحكم به معقولا وعادلا في ظل المحافظة على ممارسة الناس لحقهم في حرية الرأي والنقد والتعبير. سواء على مستوى التشريع، أو على مستوى التطبيق القضائي. ولا يصح بأي حال من الأحوال أن يحتج بمكافحة خطاب الكراهية من أجل تبرير قمع حرية الرأي والتعبير. Abstract: If the criminalization of discrimination and hate speech is necessary to preserve the rights of others and preserve the principle of equality in society, and therefore its cohesion and continuity, it should be noted that this criminalization is in contrast to another more certain and original right, and a great principle of the principles underlying high societies, is the principle of freedom of opinion and expression. Therefore, the restriction of this right in any form should be a necessary restriction, appropriate to its nature in that it is the original right and the general principle. According to this premise, the criminalization of discrimination and hate speech needs to be surrounded by a set of necessary controls that make the ruling reasonable and fair while preserving the exercise of people's right to freedom of opinion, criticism and expression. Both at the level of legislation, and at the level of judicial application. In no case is it right to invoke the fight against hate speech in order to justify the suppression of freedom of opinion and expression.
