مدى استقلالية المحكمة الدستورية في الدستور البحريني مقارنة بالتعديل الدستوري الجزائري لعام2020

الملخص
الهدف من الدراسة هو الوقوف على مدى استقلالية المحكمة الدستورية هيكليا ووظيفيا وفق خطة تم التركيز فيها على ابراز دعائم استقلالية المحكمة الدستورية في الدستورين البحريني والجزائري المعدل عام2020، وكذا بيان المؤثرة على تشكيلة وعمل المحكمة الدستورية من خلال الاعتماد على المنهج التحليلي والمقارن لإعطاء البحث حقه من الدراسة. وقد خلصت الدراسة إلى جملة من النتائج أبرزت إرادة المؤسس الدستوري البحريني والجزائري على التأكيد على استقلالية المحكمة الدستورية كهيئة قضائية وتعزيز دورها في حماية قواعد الدستور وضمان الحقوق والحريات المقررة للأفراد، غير أن الواقع الذي تعمل في إطاره المحكمة الدستورية في الدستورين البحريني والجزائري افرز جملة من المعوقات التي قد تؤثر على عمل واستقلالية المحكمة الدستورية، وهو ما يوجب ضرورة تمكين المحكمة الدستورية فعليا ممارسة اختصاصاتها في مجال الرقابة الدستورية كضمانة حقيقية لتعزيز مبدأ سمو الدستور وصون حقوق وحريات الأفراد. الكلمات الدالة: محكمة دستورية، رقابة دستورية، دستور، إخطار ، دفع بعدم الدستورية. Abstract: The aim of the study is to identify the extent of the independence of the Constitutional Court structurally and functionally according to a plan that focused on highlighting the pillars of the independence of the Constitutional Court in the Bahraini and Algerian constitutions amended in 2020, as well as the factors affecting the composition and work of the Constitutional Court, and relying on the analytical and comparative approach to give the research its right to study. The study concluded with a number of findings that highlight the will of the Bahraini and Algerian constitutional founders to emphasise the independence of the Constitutional Court as a judicial body and strengthen its role in protecting the rules of the Constitution and guaranteeing the rights and freedoms of individuals. However, the reality under which the Constitutional Court operates in the Bahraini and Algerian Constitutions has created a number of obstacles that may affect the work and independence of the Constitutional Court, which necessitates the need to enable the Constitutional Court to effectively exercise its competencies in the field of constitutional oversight as a real guarantee to strengthen the principle of the supremacy of the Constitution and safeguard the rights and freedoms of individuals.
