الضوابط القانونية لتنفيذ الالتزام بالتبصير الطبي في الجراحة الروبوتية

الملخص
ترتبط التدخلات الطبية –العلاجية والجراحية- على جسم المريض بموافقة هذا الأخير ورضاه بها، فالتكوين العلمي للأطباء والجراحين لا يمنح هؤلاء أية سلطة لتصرف في أجساد المرضى فأدنى ممارسة طبية تقابلها مجموعة من الإلتزامات الملقاة قانونا على عاتق الأطباء، فإلى جانب الإلتزام بضمان سلامة المريض وحفظ أسراره يخضع الطبيب للإلتزام بالتبصير الطبي للمريض كخطوة أولية في مسار الحصول على رضاه المتبصر بالتدخل الجراحي بمساعدة روبوت. Medical practices –therapeutic and surgical - on the patient's body are linked with the latter's approval and satisfaction with them. The scientific training of doctors and surgeons does not give them any authority to dispose of patients' bodies, as the minimum medical practice is met by a set of obligations legally imposed on doctors In addition to the obligation to ensure the patient's safety and preserve his secrets, the doctor is subject to the obligation to provide medical insight to the patient as an initial step in the path of obtaining his insightful satisfaction with surgical intervention with the help of a robot.
