التدخل التنظيمي في مجال الاستثمار: من اختلالات الاستقرار القانوني إلى مبررات الضبط والسيادة الاقتصادية

الملخص
تناقش هذه الدراسة مسألة التدخل التنظيمي في مجال الاستثمار من زاوية تحليلية، منطلقا من اختلالات ملموسة في البيئة التنظيمية أثرت على فعالية النصوص وعلى الضمانات الدستورية المكفولة للمستثمر، وتهدف إلى تجاوز الطرح التقليدي الذي يفصل بين التدخل بالتنظيم والحرية الاقتصادية، من خلال إبراز التفاعل المعقد بين مشروعية التدخل وحدودها الدستورية والاقتصادية، حيث تنطلق الدراسة من فرضية مفادها أن غياب التوازن بين متطلبات السيادة التنظيمية والحوكمة الاقتصادية أفرز حالة من عدم اليقين القانوني، وباتالي البحث في إمكانيات ترشيد التدخل التنظيمي وفق ضوابط دقيقة، ومقاربة تضمن الفعالية دون الإضرار بحرية المبادرة، وتعيد بناء مشروعية التنظيم في ضوء متغيرات الاقتصاد الحديث. This study discusses the issue of regulatory intervention in the field of investment from an analytical perspective, based on tangible imbalances in the regulatory environment that have affected the effectiveness of texts and the constitutional guarantees guaranteed to investor. It aims to go beyond the traditional approach that separates regulatory intervention from economic freedom, by highlighting the complex interaction between the legitimacy of intervention and its constitutional and economic limits. This study is based on the hypothesis that the absence of a balance between the requirements of regulatory sovereignty and economic governance has created a state of legal uncertainty. Consequently, it explores the possibilities of rationalizing regulatory intervention according to precise controls and an approach that ensures effectiveness without harming freedom of initiative, and rebuilds the legitimacy of regulation in light of the variables of the modern economy.
