الوصفة الطبية كأداة للرقابة على استعمال الأدوية ذات الخصائص المؤثرة عقليا

الملخص
يقينا منه بضرورة مسايرة التطورات الحاصلة في مجال الاستعمال الغير الشرعي للأدوية ذات الخصائص المؤثرة عقليا، في ظل تصاعد وتيرة تعاطي هذه الأدوية في غير الإطار الشرعي لها وهو الغرض الطبي، كان على المشرع الجزائري أن يتدخل ويُرْسِي بناء جدار قانوني يواجه به سوق المؤثرات العقلية من جهة وسوء استعمالها من جهة أخرى، فأجرى عدة تعديلات على نصوص قانونية كانت سارية بعدما تأكد من قصورها كما أصدر عدة نصوص تنظيمية فرضتها حتمية مجابهة التغيرات الحاصلة سيما على المستوى الوطني، فكان من بين ما كرسه كخطوة جد مهمة في هذا المجال "مبدأ التصنيف الوطني للمؤثرات العقلية" إلى جانب فرضه عدة قواعد تحكم الوصفة الطبية الخاصة بالأدوية المؤثرة عقليا. Convinced of the necessity to keep pace with developments in the illicit use of psychotropic drugs especially in light of the increasing trend of using such substances outside their legitimate medical context the Algerian legislator found it imperative to intervene and establish a legal framework capable of confronting both the psychotropic drug market and their misuse. Consequently, several amendments were made to existing legal texts after their inadequacy became evident, and new regulatory provisions were enacted in response to the pressing need to address these evolving challenges, particularly at the national level. Among the most significant steps taken in this regard was the establishment of the principle of national classification of psychotropic substances, alongside the imposition of several regulatory rules governing the issuance of medical prescriptions for psychotropic drugs.
