النوازل الفقهية في الثورة الجزائرية

الملخص

إنَ الجنسية بمفهومها المعاصر هي أمر حادث لم يظهر إلاَ في أواخر القرن التاسع عشر ميلادي لما استجدَ على البشرية من رسم للحدود وكثرة النزاعات وتشعب للحروب، فقد كان ما يشابهها في الجاهلية ما يحمله مصطلح العصبية القبلية غير أنه كان أخص منها في معناه ثمَ تهذَب معناها ومدلولها مع مجيء الإسلام الذي جعل الرابطة بين المسلمين إنما هي بالانتساب لهذا الدين مهما تباعدت الأقطار ومهما كانت الظروف سواء في السلم أو في الحرب، وأنه لا ولاء لراية إلَا راية الإسلام، وأيما شخص أبى راية الإسلام فقد ارتد، فالتجنيس ورغم حداثته إلا أنه تترتب عليه عدة أحكام شرعية نتناولها في هذه المداخلة اتباعا ثم نبين علاقته بالردة مع إسقاط ذلك على واقع الثورة الجزائرية. فما هو مفهوم التجنيس؟ وما هي الأحكام الشرعية المترتبة عليه؟ وما هي الردة؟ وما أحكامها؟ وما علاقة التجنيس بالردة؟ وما هي الأحكام التي تلائم القضية الجزائرية زمن الثورة التحريرية فيما يتعلق بالتجنيس؟ Nationality in its contemporary sense is an accident that did not appear until the end of the nineteenth century AD, due to the recent drawing of borders and the multiplicity of conflicts and the ramifications of wars. What was similar to it in the pre-Islamic era was what was implied by the term tribal nervousness, but it was more specific than it in its meaning and then refined its meaning and connotation. With the advent of Islam, which made the bond between Muslims only by affiliation to this religion no matter how far the countries are and no matter the circumstances, whether in peace or war, and that there is no loyalty to a banner except the banner of Islam, and any person who rejects the banner of Islam has apostatized. Legal provisions that we deal with in this intervention in a follow-up and then show its relationship to apostasy with the projection of this on the reality of the Algerian revolution. What is the concept of naturalization? What are the rulings of Shariah? And what is the response? And what are its provisions? What is the relationship between naturalization and apostasy? What are the provisions that fit the Algerian case at the time of the liberation revolution with regard to naturalization?
