The new Code of Criminal Procedure No. 25/14, issued on 3 August 2025, includes reforms that can only be described as bold, with the aim of striking a balance between the rights and freedoms of individuals on the one hand and society's right to impose punishment and achieve justice on the other. The immediate appearance system has been reviewed after facing much criticism and reinforced with another complementary system consisting of procedures for offences committed in flagrante delicto, all under the name of immediate notification before the court. The immediate appearance system deals with cases ready for adjudication, while the flagrante delicto system deals with offences committed in flagrante delicto. These reforms aim to simplify trial procedures for adjudicating cases within reasonable time frames, ease the burden on the justice system, and keep pace with recent developments, while providing a legal framework to avoid violating the rights of litigants and ensure fair trials.
