ضوابط طلب الزوجة التطليق لعدم الإنفاق وللغيبة

الملخص
اتصفت التعديلات التي مست قانون الأسرة الجزائري بالجوهرية كونها شملت بالأساس توسيع إرادة الزوجة في حل الرابطة الزوجية، وذلك بإعادة صياغة بعض الطرق التي كانت تلجأ إليها لوضع حد لعلاقة زوجية يحكمها التنافر والتباعد بينها وبين زوجها، ليخلق بذلك المشرع سبل جديدة تارة بالإضافة إلى الاحتفاظ بالسبل السابقة، والتي تمكنها من فك هذه الرابطة بالاعتماد على مبدأ توسيع إرادتها في إنهاء العلاقة الزوجية بشروط محددة ومقننة من شأنها أن تحقق نوعا من المساواة بين الزوجين في الحق في إنهاء الرابطة الزوجية. The amendments that have affected Algerian Family Code were characterized by the essence that basically included the expansion of spouse's intention in the dissolution of the marriage bond, by reformulating certain methods in which it resorted to them, in order to put an end to marital relationship regulated by repulsion and remoteness between the two spouses, in which the legislature finds new methods at times, as well as keeping the previous methods, so it empowers her to dissolve this bond, based on the principle of the expansion of her intention to dissolve the marital relationship under certain and codified conditions that will achieve some sort of equality between spouses in the right to dissolution of the marriage bond.
