التأصيل المقاصدي للأخلاقيات النقابية

الملخص

يهدف البحث إلى بيان التأصيل المقاصدي للأخلاقيات النقابية، من خلال إبراز أهمية الأخلاق وعلاقتها بمقاصد الشريعة، وإظهار دور وأثر الأخلاق في تحقيق المصالح، بمنهج يجمع بين الاستقراء والتحليل، من خلال استقراء النصوص الشرعية المتعلقة بالبحث، وتحليلها وتقييمها. ويختص هذا البحث بالمجال المهني النقابي، وتأطير الممارسة النقابية في ضوء القيم المقاصدية لتحقيق المصالح وحفظها، سواء الخاصة بالعمال أو الموظفين والوظيفة أو العامة المتعلقة بالعمل النقابي، للوصول إلى تطبيقات تأصيلية مقاصدية لأهمّ الأخلاقيات التي لا تنفك عن العمل النقابي، سواء كانت مقدمة له، أو مصاحبة له أو تابعة له، جلبا للمصالح ودرء للمفاسد. Abstract This research aims at establishing the objective-based foundation the ethics of trade unions. It tries to highlight the importance of ethics and their relationship with the objectives of Sharia (Maqasid al-Sharia), showing the role and impact of ethics in achieving Benefits (Masalih). The methodology combines both induction and analysis, through surveying and analyzing relevant texts of the Sharia. It is also followed by the evaluation of the above-mentioned texts. This research focuses on the professional trade union field, aiming at framing union practices within the light of Maqasidi values to achieve interests and préserve them. These interests pertain to workers, employees, and the function of the job itself, as well as the general interests related to union work. The final objective is reach foundational, objective-based applications for the most important ethics that are related to union work—whether serving as prerequisite, corollary, or resulting from it in order to promote benefits and prevent harms.
