الملخص
عرفت المجتمعات الجزائرية قديما بالتماسك والتعاون وانتشار مكارم الأخلاق والابتعاد عن مساوئها، فظفرت بالأمن والاستقرار بين الأفراد، وهذا راجع لتماسك أسرها، ولكن سرعان ما تزعزع هذا الاستقرار، وظهر الشقاق والفراق بينها، فركن الرجال والنساء للطلاق أو الخلع كحلول لفك وثاق الزوجية، متناسين أو غافلين أن لقرارهم هذا انعكاسا على حياتهم وحياة الأبناء، وقد اعترضتني في هذه الدراسة إشكالية بخصوص أسباب انتشار الطلاق والخلع، وآثار ذلك على الأسر الجزائرية، وفي هذا المقال عرضت مجموعة من قضايا الطلاق والخلع في ولاية قالمة بالخصوص، واستخرجت منها ومن قضايا أخرى أسباب تلكما الظاهرتين، وانعكاسهما على حياة الأسر الجزائرية، سواء على الزوجين أو الأبناء، وفي الأخير قدمت بعض الحلول للحد أو التقليل منهما مستندا إلى اقتراحات قضاة جزائريين وأردنيين وبعض المقالات. Algerian societies were known in the past for their cohesion, cooperation, the spread of noble morals, and the avoidance of vices, thus achieving security and stability among individuals. This was attributed to the solidarity of their families. However, this stability was quickly shaken, and discord and separation appeared among them. Men and women resorted to divorce or khul' as solutions to dissolve the marital bond, forgetting or neglecting that their decision has repercussions on their lives and the lives of their children. This study encountered a problem regarding the reasons for the spread of divorce and khul', and their effects on Algerian families. In this article, a collection of divorce and khul' cases in the Wilaya of Guelma in particular is presented. The causes of these two phenomena and their repercussions on the lives of Algerian families, whether on the spouses or the children, are extracted from these cases and other issues. Finally, some solutions are proposed to limit or reduce them, based on suggestions from Algerian and Jordanian judges and some scientific articles.
