Modern legal systems are increasingly challenged by the difficulty of legally qualifying emerging cybercrimes due to their rapid evolution and complex technological nature. ”his paper aims to highlight the shortcomings of traditional legal frameworks and examine the problematic nature of the legal classification of novel cyber-offenses, such as digital extortion, cyber fraud,’and privacy violations. Adopting both a theoretical approach—through the analysis of definitions and legal elements—and a practical one—by comparing legislative and judicial experiences—the article proposes conceptual and normative criteria to guide the legal qualification of these emerging crimes, in line with recent developments in legislation and legal scholarship
