الملخص
تعد حماية الطفل المحضون جزائيا من المسائل التي نضمها المشرع في نص المادة 328 من قانون العقوبات لما لها من أهمية على مستوى رعاية الطفل و استقرار الأسرة و المجتمع، وضمانة لمصداقية الأحكام القضائية الصادرة بشأن حضانة الطفل المحضون، ونص المادة 328 من قانون العقوبات تعاقب كل من الأب أو الأم أو أي شخص لا يقوم بتسليم طفل قضي في شأن حضانته بحكم مشمول بالنفاد المعجل أو بحكم نهائي، كما تعاقب أيضا على خطف الطفل المحضون أو إبعاده . The protection of the child in criminal custody is one of the issues included by the legislator in the text of Article 328 of the Penal Code because of its importance at the level of child care and the stability of the family and society, and a guarantee of the credibility of judicial rulings issued regarding the custody of the child in custody. The text of Article 328 of the Penal Code punishes the father, the mother, or any person who does not hand over a child whose custody has been decided by an expedited ruling or by a final ruling. It also punishes the kidnapping of the child. Child custody or deportation.
