الملخص
الملخص : من خلال هذه الدراسة سيتم معالجة القانون 20-05 ، هذا الأخير الذي تعززت به المنظومة القانونية في الجزائر، في ظل انتشار هذه الظاهرة في المجتمع، وبعد التصعيد الخطير لهذا النوع من الممارسات في السنوات الأخيرة . وتجسيدا للالتزامات المتعلقة بالاتفاقيات الدولية التي تمت المصادقة عليها في هذا المجال، جاء المشرع بآليات ردعية عقابية وأخرى وقائية، مع تعزيز سبل مواجهتها بإنشاء المرصد الوطني للوقاية من التمييز وخطاب الكراهية، وتمكينه من وسائل قانونية فعالة من شأنها الحد منه . Law 05-20on the prevention and fight against discrimination and hate speech will be addressed in the current study.The latter, which strengthened by the legal system in Algeria in light of the spread of the phenomenon of discrimination and hate speech in Algerian society, following the serious escalation of this type of practice in recent years. To embody the international obligations related to the international treaties ratified by Algeria in this field, the drafter of this law provides for deterrent, punitive and preventive mechanisms, while strengthening the means of confronting these crimes by establishing the National Observatory for the Prevention of Discrimination and Hate Speech, and providing it with effective legal means that would limit these practices.
