خصوصية منازعات الأحزاب السياسية باعتبارها دعاوى إدارية بقواعد خاصة .

الملخص

تعتبر منازعات الأحزاب السياسية منازعات إدارية يختص بها القضاء الإداري، غير أنها لا تخضع للقواعد العامة المنصوص عليها في قانون الإجراءات المدنية والإدارية، ما يجعلها منازعات إدارية خاصة، تتميز عنها في جملة من الخصائص والإجراءات، خاصة من حيث أجالها القصيرة القريبة منها إلى الاستعجال عن العادي. وكذلك من خلال أجال الفصل من طرف مجلس الدولة المحددة بشهرين في القضايا العادية ومدة 48 سلعة في المادة الاستعجالية، وكذلك تتميز من خلال عدم تطبيق مبدأ التقاضي على درجتين فيها اذ ينظر فيها مجلس الدولة كاول وأخر درجة ، وهي خصائص تبررها طبيعة المنازعة الحزبية. وما تتطلبه من سرعة تكريسا للحقوق والحريات العامة وحمايتها من طرف القضاء ،وإعطاء كل مرحلة من مراحل تكوين الأحزاب السياسية، وصولا الى الاعتماد والنشاط ، وتوقيف وحل الأحزاب رقابة قضائية على ذلك بناء على المنازعات المتعلقة بها. Disputes involving political parties are considered administrative disputes that fall under the jurisdiction of the administrative judiciary. However, they are not subject to the general rules stipulated in the Code of Civil and Administrative Procedure, which makes them special administrative disputes. They are distinguished by a number of characteristics and procedures, particularly in terms of their short deadlines, which are closer to those of urgent proceedings than ordinary ones. Moreover, this is reflected in the adjudication deadlines imposed on the Council of State: two months in standard cases and 48 hours in summary proceedings. An additional distinguishing feature is the inapplicability of the principle of dual-instance jurisdiction, wherein the Council of State acts as the court of first and final resort. Such characteristics are warranted by the very nature of partisan conflicts. and the swiftness they necessitate in order to consecrate public rights and freedoms and safeguard them through the judiciary. This ensures that judicial review is applied to each phase of a political party's existence—from its establishment and accreditation, to its operations and potential suspension or dissolution—addressing the disputes pertinent to each stage.
