صلاحيات رئيس المجلس الشعبي البلدي في مكافحة البنايات الفوضوية. Powers Of The President Of The Municipal People’s Combating Illegal Buildings.

الملخص
تعتبر البنايات الفوضوية ظاهرة نتجت عن الظروف الإستثنائية كونها ليست مطابقة للقوانين والتنظيمات المتعلقة بالعمران، وهذا راجع للأزمات التي تمر بها الدولة الجزائرية المتمثلة في عجزها عن تلبية الإحياجات السكانية الخاصة بالتمتع بالحق في السكن، مما يؤدي بالسكان إلى تشييد بنايات تتميز بعدم إحترام قواعد البناء باستعمال مواد غير مطابقة وبدون ترخيص، وهو ما يخول لرئيس المجلس الشعبي البلدي سلطات واسعة في مجال الضبط الإداري بنوعيه لمكافحة هذه الظاهرة. وفي هذا الإطار لرئيس المجلس الشعبي البلدي إتخاذ التدابير الضرورية والإجراءات الكفيلة بالقضاء على البنايات الفوضوية، من خلال المخططات العمرانية والرخص التي يمنحها لطالبيها متى توفرت الشروط اللازمة للبناء، مشددا على إقامة البنايات أثناء تشييدها بالوسائل التي منحت له، وذلك من أجل المحافظة على النظام العمراني وعلى سلامة الأشخاص ووقايتهم من فوضى العمران. Chaotic building are considered a phenomen on resulting from exceptional cirumestances as they are not in conformitywith the laws and regulations related to urbanization and thisis due to the crises experienced by the Algerian state represented by itsinability to meet the population needsrelated to the enjoyment of the right to housing, which leads the population to construct buildings characterized by non-respect of buildingrules and the use of materials non conformity and without a license. Which gives the President of the Municipal Peoples Council wide powers in the field of administrative conrol of both kinds to comatthis phenomenon. In this context, the President of the Municipal peoples Assembly shall take the necessary measures and measures to eliminate the chaotic buildins. Through urban plans and the license shegrant to their applicants whenever the necessary conditions for construction are met. The safety of people and their protection from the chaos of life.
