سياسة التجريم والعقاب لجريمـــة الاتجـــار بالبشــر في التشريع الجزائري

الملخص
تعد جريمـــة الاتجـــار بالبشــر جريمة لا تقل أهمية عن الجرائم الأخرى من ناحية الخطورة، حيث أنها تمس بحرية وكرامة البشر، وتقوم على أفعال ووسائل غير مشروعــة، بهدف استغلال الأشخاص في أفعال يمقتها المجتمع ويحرمها القانون، كما يميزها القانون الدولي والوطني بأنها جريمة منظمة وعابرة للحدود، ولا يعتد برضا الضحية في قيامها، حيث يتطلب لقيامها توافر ركنين على غرار الركن الشرعي، الركن المادي يتمثل في الأفعال المحظورة، والركن المعنوي القائم على العلم والإرادة بنية الإستغلال، إضافة إلى خصائص تجعلها جريمة مركبة، مستمرة أو وقتية حسب الحالــة. تناولها المشرع الجزائري بتعريف دقيق ضمن قانون خاص (23-04) مقتديا بأحكام بروتـــــوكــول باليــــــرمـــــو، مع إبراز خصائصها وبنيتها القانونية. The crime of human trafficking is no less serious than other major crimes in terms of its gravity, as it infringes upon human freedom and dignity. It is based on unlawful acts and means with the aim of exploiting individuals in activities that are condemned by society and prohibited by law. Both international and national legal frameworks recognize it as an organized and transnational crime. The victim’s consent is not considered valid for its commission. The crime requires two key elements: the legal element, and the material element, which consists of the prohibited acts; as well as the moral element, which involves knowledge and intent to exploit. Additionally, it possesses characteristics that make it a complex crime, which may be continuous or instantaneous depending on the case. The Algerian legislator addressed it with a precise definition in a special law (Law No. 23-04), following the provisions of the Palermo Protocol, while highlighting its characteristics and legal structure
