تلقي الموظف العمومي للهدايا بين الاباحة والتجريم في التشريع الجزائري

الملخص
من أجل الحفاظ على المال العام والخدمة العمومية ونزاهة الوظيفة العامة جرم المشرع الجزائري سلوك تلقي الموظف العمومي للهدايا بموجب المادة 38 من القانون 06-01 المتعلق بالوقاية من الفساد ومكافحته المعدل والمتمم لأنه يمس بهذه الأساسيات الثلاثة، فبارتكابه لهذه الجريمة يخالف و يتحايل على الأطر الرقابية والقانونية المنظمة للمال العام ويؤثر على السير الحسن للخدمة العمومية ويسيئ لمبدأ المساواة أمام المرفق العمومي، كما يضر كذلك بشفافية ونزاهة الوظيفة العامة ككل. ورغم أنه يوجد مجال مقنن لإباحة ما يشبه ذلك السلوك في التشريع الجزائري إلا أنه لا يعدو أن يكون جريمة متكاملة الأركان كجريمة تلقي الهدايا التي يبدأ ركنها المادي بتقديم الهدية من طرف شخص آخر للموظف العمومي الجاني ليقوم هو بتلقيها أو قبولها صراحةً على أن يؤثر ذلك على مهامه تأثيراً يُفترض اثباته. Abstract: In order to preserve public funds, public service, and the integrity of the Public service, the Algerian legislature criminalized the behavior of public official receiving gifts under Article 38 of Law 06-01 on the Prevention and Combating of Corruption, as amended and supplemented. This offense violates these three fundamental principles. By committing this crime, public officials violate and circumvent the regulatory and legal frameworks governing public funds, impact the smooth running of the public service, undermine the principle of equality before the public service, and harm the transparency and integrity of the Public service as a whole. Although there is a legal framework for the permissibility of such behavior in Algerian law, it is no more than a fully elements crime, such as the crime of receiving gifts, the material element of which begins with the gift being offered by another person to the offending public official, who then explicitly receives or accepts it, provided that this impacts their duties in a manner that must be proven.
