المسؤولية الناتجة عن إبرام العقود الإلكترونية-دراسة مقارنة.

الملخص
عرف العالم تطورا ملحوظا و هذا يرجع بطبيعة الحال إلى تطور التكنولوجيا و ظهور الإنترنت الذي جعل العالم قرية صغيرة، فهذا التطور التكنولوجي أثر في مختلف المجالات و من بينها مجال العقود. شهدت العقود قفزة كبيرة بعد ظهور وسيلة جديدة و سريعة للتعاقد، فأصبح من الممكن إبرام عقود حول سلع رغم بعد المسافات، فهذا الواقع الذي فرض نفسه دفع بمحتلف التشريعات إلى التسارع من أجل جعل نصوصها القانونية تتماشى مع هذا الواقع، و العمل على تنظيم ما يسمى بالعقود الالكترونية. من أهم النقاط التي يجب على مختلف التشريعات أن تركز عليها هي المسؤولية الناتجة عن إبرام هذا النوع من العقود، فالاقرار بوجود مسؤولية يسمح بخلق الأمان و الاستقرار في المعاملات التجارية الالكترونية. The world has witnessed significant development ,and this is naturally due to the development of technology and the emergence of the internet, which has made the world a small village, this technological development has an impact on all fields, including contracts . Contracts have witnessed a massive leap after the appearance of a new and fast means of contracting,as it has become possible to conclude contracts for goods despite the long distances. This reality that established itself has moved various legislations to accelerate in order to keep their legal texts in accordance with this reality, and for the purpose of regulating what are called electronic contracts. One of the most important points that various legislations must focus on is the liability appearing from concluding this type of contract. Recognizing the existence of liability allows for the creation of security and stability in e-commerce transaction
