الرقابة على دستورية المعاهدات في ظل التعديل الدستوري لسنة 2020

الملخص
خلافا لما تم العمل به في الدساتير المتعاقبة للجزائر، فقد ادخل على موضوع الرقابة الدستورية على المعاهدات الدولية عدة متغيرات في التعديل الدستوري لسنة 2020، حيث أن الصبغة القضائية التي أصبحت تتصف بها المحكمة الدستورية، أدى إلى توسيع عملها سواء على مستوى الاختصاصات الدستورية أو التشكيلة، الأمر الذي يساهم في ضمان وتكريس مبدأ سمو الدستور واحترام مبدأ تدرج القواعد القانونية وتحقيق التوافق الدستوري، يضاف إلى ما سبق أن الرقابة على دستورية المعاهدات التي تمارسها هذه المحكمة رقابة سابقة ولاحقة على المصادقة، ونشير إلى عدم إلزامية هذا الإجراء في هذا المقام، يضاف إلى ذلك الاشكاليات المتعلقة بمواعيد الإخطار بالنسبة للمحكمة الدستورية. Contrary to what has been practiced in successive Algerian constitutions, several changes were introduced to the issue of constitutional review of international treaties in the 2020 constitutional amendment. The judicial nature of the Constitutional Court has expanded its work, both in terms of constitutional jurisdiction and composition. This contributes to ensuring and enshrining the principle of constitutional supremacy, respecting the principle of the hierarchy of legal rules, and achieving constitutional consensus. Furthermore, the constitutional review of treaties exercised by this court involves both prior and subsequent review of ratification. We note that this procedure is not mandatory in this context. Furthermore, there are issues related to notification deadlines for the Constitutional Court.
