المكافحة المؤسساتيــــــــــة للجريمة الالكترونية في التشريـــــــــــع الجزائــــــــــــري

الملخص
تناول هذا المقال ظاهرة الجريمة الإلكترونية كإحدى التحديات المستجدة في العصر الرقمي، والتي أفرزها التطور المتسارع لتكنولوجيا المعلومات والاتصالات، وقد ركّزت الدراسة على الجهود التي تبذلها المؤسسات الوطنية في الجزائر لمكافحة هذه الجرائم، من خلال تحليل الإطار القانوني والتنظيمي المعتمد، واستعراض أهم الهيئات والجهات المختصة مثل الهيئة الوطنية للوقاية من الجرائم المتصلة بتكنولوجيات الإعلام والاتصال، والمصالح الأمنية التابعة للشرطة والدرك الوطني، كما تم التطرق إلى آليات التنسيق والتعاون بين هذه المؤسسات، ومدى فعاليتها في التصدي للجريمة الإلكترونية باعتبارها جريمة متطورة تقنيًا، وبيّنت الدراسة أن الجهود المبذولة لا تزال تواجه تحديات متعددة، سواء على مستوى الموارد البشرية والتقنية، أو على مستوى التشريعات المتخصصة، وخلص المقال إلى ضرورة تعزيز التعاون بين الهيئات وتحديث الإطار القانوني بشكل دوري، بما يتماشى مع التطور المستمر للجريمة الإلكترونية. This article addresses the phenomenon of cybercrime as one of the emerging challenges in the digital age, resulting from the rapid development of information and communication technologies. The study focuses on the efforts made by national institutions in Algeria to combat these crimes by analyzing the adopted legal and regulatory framework and reviewing the main relevant bodies and institutions such as the National Authority for the Prevention of Crimes Related to Information and Communication Technologies, in addition to the national security services of the police and the national gendarmerie. The article also discusses the coordination and cooperation mechanisms between these institutions and their effectiveness in confronting cybercrime, which is technically advanced. The study indicates that current efforts still face multiple challenges, whether in terms of human and technical resources or specialized legislation. The article concludes with the need to strengthen cooperation among agencies and regularly update the legal framework in line with the continuous evolution of cybercrime.
