اثار عقد الكفالة التضامنية

الملخص
الملخص: تنعقد الكفالة التضامنية لتقوية الائتمان في التزام أصلي سابق عليها، ومتى انعقدت بالشكل الذي تتطلبهُ القانون فأن هذا الانعقاد سيرتب اثاره بين أطراف العلاقة العقدية، ولما كانت الكفالة التضامنية عقداً تابعاً فأن تعدد العلاقات الناشئة هي النتيجة الحتمية لذلك، فلا يقتصر الامر على علاقة الكفيل المتضامن بالمدين او علاقته بالدائن بل قد يتعدد الكفلاء المتضامنين سواء كان تعددهم بعقد واحد ام في عقود متوالية مستقلة. ان تعدد الأطراف يترتب عليه الكثير من الاثار القانونية، حيث ان اثر علاقة الكفيل المتضامن بالدائن يظهر ابتداءً بمطالبة الأخير له بجميع مبلغ الدين فإذا انتهى الامر بالوفاء، يمكن للكفيل الموفي الرجوع على المدين بالمبالغ التي اوفاها سواء كان هذا الرجوع بطريقة ودية او بإقامة دعوى قضائية ويعد ذلك اثر لعلاقة الكفيل المتضامن بالمدين، بالإضافة الى ان البحث في اثار الكفالة التضامنية يسلط الضوء على موضوع غاية الأهمية الا وهو الدفوع القانونية المقررة للكفيل المتضامن. Abstract: The solidarity guarantee to strengthen the credit is held in an original obligation prior to it, and when it is held in the form required by law, this meeting will arrange its effects between the parties to the contractual relationship, and since the solidarity guarantee is a subsidiary contract, the multiplicity of relations arising is the inevitable result of that, so it is not limited to the relationship of the joint guarantor with the debtor or his relationship with the creditor, but there may be multiple joint guarantors, whether their multiplicity is one contract or in separate successive contracts. The multiplicity of parties entails a lot of legal effects, as the impact of the relationship of the joint guarantor with the creditor is represented starting with the latter's claim for all the amount of the debt, and if the matter ends up being paid, the paying guarantor can refer to the debtor with the amounts he has paid, whether this return is in an amicable manner or by filing a lawsuit, and this is an effect of the relationship of the joint guarantor with the debtor, in addition to that the research on the effects of the solidarity guarantee sheds light on a very important topic, which is the legal defenses prescribed for the joint guarantor.
