عمل الأطفال بين الواقع الاجتماعي والحماية القانونية

الملخص
تعد ظاهرة عمل الأطفال من الظواهر الاجتماعية المستعصية في الوقت الحالي، وتخلق نتائج وخيمة نتيجة لتعرضهم للعمل منذ سن مبكرة، بغض النظر عن القوانين الصارمة. يشكل حقوق الطفولة مركزية في معظم الأديان، وتسعى المجتمعات لبناء بنية تحتية تؤمن بحقوق الطفل، وهو ما تجسد في قانون حقوق الطفل الذي تم التوافق عليه دوليا في عام 1989 وأصبح قانونا دوليا في 1990، وقد صادقت عليه 174 دولة بما في ذلك الجزائر. على الرغم من توافر القوانين، فإن استغلال الأطفال في العمل لا يزال شائعًا وواسع الانتشار عالميًا، مع اختلاف نسب الانتشار بسبب العوامل الاجتماعية والاقتصادية والبيئية. في هذه الورقة، سنحاول استكشاف واقع عمالة الأطفال في الجزائر بين الواقع المجتمعي والقوانين المحلية التي تهدف لحماية حقوق الطفولة في هذا السياق. The phenomenon of child labor is among the social phenomena that have taken on numerous dimensions at present due to the dire consequences of child labor for years regardless of the strict laws that limit this phenomenon and the need that has driven families to push their children onto the streets. There is no doubt that the rights of children and their care have been a focus of many religions, where rules of conduct have been established to help build a society characterized by justice and love. In 1989, there was consensus on the rights of the child, which became international law in 1990 and was ratified by 174 countries, including Algeria. One of its key principles is the child's right to health and access to primary education. The exploitation of children through forcing them to engage in work unsuitable for their age is a common and widespread practice worldwide, not limited to any specific place or country, but quite the opposite. However, the prevalence of child labor varies from one place to another due to differences in social, economic, and environmental factors. In this paper, we will try to answer the question of child labor in Algeria, between the societal reality and the laws that protect childhood in this field
