الملخص
الملخص يعد الخلاف الفقهي من الظواهر التي واكبت الفقه الإسلامي في عصوره التشريعة المختلفة، وقد قعَّدَ الفقهاء والأصوليون قواعد وضوابط تحكم الاختلافات الفقهية بين المذاهب وذكروا طائفة من تلك القواعد في مدوناتهم الفقهية. وتهدف هذه الدراسة إلى جمع أهم القواعد المتداولة في الأدبيات الفقهية والأصولية، واستجلاء الضوابط المرتبطة بها ، ورصد أهم تطبيقاتها القديمة والمعاصرة، وصولاً إلى النتائج والتوصيات التي ستتوصل لها هذه الدراسة، والتي سيتم إيداعها في الخاتمة. Abstract The jurisprudential dispute is one of the phenomena that accompanied Islamic jurisprudence in its various legislative eras، and jurists and fundamentalists have set rules and regulations governing jurisprudential differences between schools and mentioned a range of those rules in their jurisprudential blogs. This study aims to collect the most important rules circulated in the jurisprudence and fundamentalist literature، clarify the controls associated with them، and monitor their most important ancient and contemporary applications، leading to the results and recommendations that this study will reach، which will be deposited in the conclusion
