الملخص

تعتبر الرقابة التوافقية من بين المستحدثات الرقابية في التعديل الدستوري لسنة 2020، ومضمون الرقابة التوافقية هو رقابة مدى توافق القوانين والتنظيمات مع المعاهدات، والهدف من ذلك ضمان احترام مبدأ سمو المعاهدات، وبالرغم من أن المؤسس الدستوري كرس مبدأ سمو المعاهدات على القوانين منذ دستور 23 فيفري 1989، إلا انه لم يُخضع القوانين والتنظيمات إلى رقابة توافقها مع المعاهدات، مما يجعلها تفلت من الرقابة حتى لو كانت لا تتوافق مع المعاهدات. وفي التعديل الدستوري لسنة 2020 قام المؤسس الدستوري في الجزائر باستدراك ذلك النقص باستحداثه الرقابة التوافقية، والتي أسندت للمحكمة الدستورية. conventionality control is one of the new oversight innovations in the 2020 constitutional amendment, The content of conventionality control is the control of the extent to which laws and regulations are compatible with treaties, The aim is to ensure respect for the principle of the supremacy of treaties, The constitutional founder although he enshrined the principle of the supremacy of treaties over laws since the constitution of February 23, 1989, However it did not subject the laws and regulation to the control of their conformity with treaties, which makes it escape even if it does not comply with treaties, Therefore the constitutional founder addressed this deficiency and created consensual oversight under the constitutional amendment of 2020 and assigned this task to the Constitutional Court.
