In this research, we address the challenges posed by artificial intelligence to the criminal law system, where we classify the various forms of AI-supported criminal activities and identify the associated judicial and territorial obstacles. We then analyze the criminal responsibility gap that arises when autonomous AI systems commit harmful acts without clear human intent or negligence. We also review the use of AI-based risk assessment tools within the criminal system itself, highlighting concerns regarding reliability, bias, and the balance between human and algorithmic decision-making. Additionally, we highlight the legal frameworks dedicated to dealing with AI crimes, and finally, we offer proposals for legal reforms that balance technological innovation on one hand with accountability and the protection of fundamental rights on the other.
