تعزيز حماية الأملاك الوقفية ـ حتمية أم خيارـ

الملخص
مما لاشك فيه أن الأملاك الوقفية تحتاج إلى مراجعة شاملة لمنظومتها القانونية، بحيث ترتفع أصوات الخبراء والمتخصصين لإعادة النظر بالكامل في أحكام القانون رقم 91-10 المؤرخ في 27 أفريل 1991 والمتعلق بالأوقاف، المعدل والمتمم، هذا القانون الذي لطالما عُلقت عليه الآمال و الأماني وقت صدوره ، وحتى بعد تعديله وتتميم أحكامه سنتي 2001 و 2002 ، في اتجاه تحقيق القفزة النوعية المرجوة لترقية الوقف، غير أن المؤشرات والاحصائيات المسجلة على أرض الواقع أثبتت للأسف عكس ذلك. وإذا كانت مقاربة هؤلاء المتخصصين تقوم في جوهرها على ضرورة مراجعة الصيغ التقليدية في تسيير الأوقاف و استثمارها وتنميتها، بما يٌوسع نطاق الاستثمار الوقفي ويُنوع أوجهه، غير أن العديد منهم يغفل الجانب المتعلق بحتمية إضافة أحكام جزائية جديدة تكفل تعزيز حماية الأملاك الوقفية من كل مظاهر الاعتداء ، فضلا عن صور النهب والتبديد والإهمال التي طالتها للأسف عبر مختلف الحقب الزمنية. There is no doubt that wakf property require a thorough overhaul of their legal framework, given the voices of experts and specialists who advocate a complete revision of the provisions of law No. 91-10 of April 27, 1991, as amended and supplemented, relating to wakf property. Since its promulgation, this law has always raised many hopes and aspirations, even after its provisions were amended and supplemented in 2001 and 2002, with the aim of achieving the desired qualitative leap in promoting Wakf. However, the indicators and statistics collected in the field have unfortunately revealed a reality far removed from expectations. Although the approach adopted by these specialists is essentially based on the need to review traditional formulas for the management, investment, and development of wakfs, with the aim of expanding their scope of wakf investment and diversifying its aspects, many overlook the aspect linked to the need to introduce new criminal provisions that guarantee the strengthening of the protection of wakf property against all forms of aggression, as well as against the waste and negligence that have, at different times, weakened them.
