الملخص
الملخص: يعد مفهوم دولة القانون من أهم المفاهيم و أعمقها في سياق دراسة العلاقة بين الحاكم و المحكوم، و كذا في إطار تحديد العلاقة بين مختلف الأجهزة المكونة للدولة، كونه يعبر عن خضوع للقاعدة القانونية الملزمة للجميع في سياق احترام للحقوق و التزام بالواجبات، هذا من جهة، و من جهة أخرى فإن هذا المفهوم من حيث مضمونه نجد أن أصوله متجذرة في عمق الحضارات و الأمم المختلفة، مما يعطيه مظهرا من مظاهر الرمزية القانونية، أما من حيث دعائمه و مقوماته نجد أنها واضحة و ثابتة رغم تغير آليات تطبيقها، حيث نميز من بينها : مبدأ الفصل بين السلطات، حماية الحقوق و الحريات الفردية، رقابة القضاء مبدأ تدرج القواعد القانونية، استقلال القضاء. يعد التعديل الدستوري لسنة 2020 من أهم النصوص الدستورية التي تبنتها الجزائر في محاولة لتكريس دولة القانون من خلال ما تضمنه من مظاهر على مستوى العديد من الأصعدة كالصعيد الوظيفي، و الصعيد المؤسساتي. في هذا السياق تهدف ورقتنا البحثية إلى محاولة إبراز مدى تجسيد التعديل الدستوري لسنة 2020 لدولة القانون من خلال تكريس مختلف مقوماتها المدرجة أعلاه. Abstract: The concept of the rule of law is one of the most important and profound concepts in the context of studying the relationship between the ruler and the ruled, as well as in defining the relationship between the various components of the state. On the one hand, it expresses submission to the legal rule binding on all within a context of respect for rights and commitment to duties. On the other hand, the content of this concept shows that its origins are deeply rooted in the cultures of various civilizations and nations, giving it a sense of legal symbolism. As for its foundations and components, they are clear and constant despite the changing mechanisms of their implementation. Among these, we distinguish: the principle of separation of powers, the protection of individual rights and freedoms, judicial oversight, the principle of hierarchical legal rules, and judicial independence. The 2020 constitutional amendment is one of the most important constitutional texts adopted by Algeria in an attempt to establish the rule of law through its various aspects, including the functional and institutional levels. In this context, our research paper aims to highlight the extent to which the 2020 constitutional amendment embodies the rule of law by enshrining its various components listed above.
