فعالية اليات تنفيذ رخصة البناء الالكترونية المستحدثة في التشريع الجزائري

الملخص
الملخـــــــــــص: باعتبار ان رخصة البناء هي الاداة الاساسية للنشاط العمراني في كل الدول والمجتمعات وينطبق الامر كذلك على الدولة الجزائرية ، ونظرا لأهميتها البالغة في اقامة البناء بمختلف انماطه فان المشرع الجزائري عمل على إخضاعها إلى أحكام قانون التهيئة والتعمير وكذا مجمل النصوص الأخرى المنظمة له ومنها المستحدثة اخيرا وبالتحديد نخص بالذكر اجراءات رخصة البناء الالكترونية التي تعد من المحاور الكبرى التي تستحق الدراسة لمعرفة مدى نجاعة المستجدات القانونية المقررة بشأنها ومدى تجسيدها فعليا على مختلف مشاريع البناء حرصا منه على خلق دولة تتسم بنمط عمراني عصري وسليم يقاس به مدى تحضر المدن في الدولة الواحدة وذلك باتباع الرقابة المفروضة على تنفيذ مختلف الاحكام المذكورة وهذا ما جعل دراستنا تنصب خاصة على الجانب العملي وتقييمه وفق الانماط والمعايير العالمية. Abstract: Given that the building permit is the basic tool for urban activity in all countries and societies, and the same applies to the Algerian state, and given its great importance in the establishment of various types of construction, the Algerian legislator has worked to subject it to the provisions of the law of preparation and reconstruction as well as all other texts regulating it, including the recently introduced The electronic building permit, which is one of the major axes that deserve to be studied to know the extent of the effectiveness of the legal developments decided on it and the extent of its actual realization on various construction projects in order to create a state characterized by a modern and proper urban pattern that is measured by the degree of urbanization of cities in one country by following the control imposed on the implementation of the various provisions mentioned. This is why our study focuses on the practical aspect and its evaluation according to international patterns and standards.
