الملخص
تعد الأسرة الوحدة الأساسية التي عليها قوام المجتمع وصلاحه وفساده، لذا فقد اعتنت بها كل التشريعات الإسلامية و الوضعية، حيث وضعت لها الأحكام لحمايتها من كل الجرائم التي تمس كيانها وتعرضها للخطر، ومنها الجرائم الواقعة على الشرف، الأمر الذي يستدعي مكافحتها بشتى الطرق والوسائل الشرعية والقانونية، وعليه جاءت هذه الدراسة تهدف إلى بيان الوسائل المتخذة لمكافحة هذه الجريمة في الشريعة الإسلامية والقانون الجزائري، حيث توصلنا في نهاية البحث إلى مجموعة من النتائج من أهمها أن الشريعة الإسلامية استخدمت لمحاربة هذه الجريمة المنهج الوقائي والمنهج العقابي، وهذا ماسلكه كذلك المشرع الجزائري من خلال منظومته القانونية مع بعض الخلافات بين النظامين. fundamental unit upon which the structure of society depends, and its well-being or corruption affects the entire society. Therefore, both Islamic and secular legislations have given it significant attention, establishing legal provisions to protect it from any crimes that threaten its existence and put it at risk, including crimes related to honor. This necessitates combating such crimes through all available legitimate and legal means. Accordingly, this study aims to highlight the measures taken to combat this crime in Islamic law and Algerian law. The research concludes with several findings, the most important of which is that Islamic law uses both preventive and punitive approaches to fight this crime, a stance that is also reflected in the Algerian legal system, albeit with some differences between the two systems.
