السّيادة في الدّولـة : دراسة في المفاهيم والأسُس

الملخص
الملخص: تُبرز هذه الورقة البحثية أهمية الدولة ككيان قانوني واجتماعي يقوم على أسس واضحة تتمثل في الشعب، والإقليم، والسلطة السياسية. فالدولة وحدها تمتلك القدرة على تحقيق مفهوم السيادة، باعتبارها السلطة العليا التي لا تخضع لأيّ جهة أخرى، مما يضمن استقلالية قراراتها وحماية مصالحها الوطنية. وتعد السيادة عنصرًا جوهريًا في بناء الدولة الحديثة، إذ تتيح لها ممارسة سلطاتها التشريعية والتنفيذية والقضائية داخل إقليمها دون تدخل خارجي، مع الحفاظ على وحدة مؤسساتها وضمان خضوعها للقانون. وقد عالج المشرّع الجزائري هذا المفهوم من خلال تكريس مبدأ أن السيادة ملك للشعب، يمارسها عبر الأطر القانونية والدستورية التي تضمن الشرعية والاستقرار السياسي، كما سعى إلى تحقيق التوازن بين استقلالية الدولة ومتطلبات الانفتاح الدولي، بما يحفظ سيادتها ويعزز دورها على السّاحة العالمية، ومع تصاعد التحديات الاقتصادية والسياسية في العصر الحديث، يبقى الحفاظ على السّيادة الوطنية مسؤولية جماعية تستدعي تعزيز مؤسسات الدولة، وترسيخ سيادة القانون، وتحقيق التنمية المستدامة لضمان استقرار البلاد وتعزيز مكانتها بين الأمم. Abstract: This research paper highlights the importance of the state as a legal and social entity founded on clear pillars: the people, the territory, and political authority. The state alone possesses the ability to achieve the concept of sovereignty, as it represents the supreme authority that is not subject to any other power, ensuring the independence of its decisions and the protection of its national interests. Sovereignty is a fundamental element in building a modern state, allowing it to exercise its legislative, executive, and judicial powers within its territory without external interference, while maintaining the unity of its institutions and ensuring their adherence to the law. The Algerian legislator has addressed this concept by enshrining the principle that sovereignty belongs to the people, who exercise it through legal and constitutional frameworks that guarantee legitimacy and political stability. Furthermore, efforts have been made to balance state independence with the requirements of international openness, preserving sovereignty while strengthening the country's global role. In light of increasing economic and political challenges in the modern era, maintaining national sovereignty remains a collective responsibility that necessitates strengthening state institutions, upholding the rule of law, and achieving sustainable development to ensure national stability and enhance Algeria’s standing among nations.
