الضرر البيئي في التشريع الجزائري Environmental Damage In Algerian Legislation

الملخص
تهدف الدراسة إلى الوقوف على مفهوم الضرر البيئي، بالإضافة إلى التعرف على خصوصية الضرر البيئي القانونية في التشريع الجزائري، وقد توصلت الدراسة إلى أن هناك خصوصية قانونية للضرر البيئي حيث أنه يتسم بالتأثير غير المباشر الذي ينتج عنه صعوبة في إثبات العلاقة السببية بين حدوث الضرر والقائم بفعله، كما يتسم بأنه طويل ومتراخي الأمد مما يؤدي إلى سقوط المطالبة بالتعويض، كما هناك صعوبة كبيرة في اثبات المصلحة في الدعوى عن الضرر البيئي؛ نظرًا لأنه تراث مشترك لكل الإنسانية، بالإضافة إلى أنه ضرر لا يمكن السيطرة عليه لسرعة انتشاره. The study aims to understand the concept of environmental damage, in addition to identifying the legal specificity of environmental damage in Algerian legislation. The study concluded that there is a legal specificity to environmental damage as it is characterized by an indirect effect that results in difficulty in proving the causal relationship between the occurrence of the damage and the one who did it. It is also characterized by being long and lax, which leads to the failure of the claim for compensation. There is also great difficulty in proving interest in a lawsuit for environmental damage. Since it is a common heritage of all humanity, in addition to being an uncontrollable harm due to the speed of its spread.
