الملخص
الملخص: تبرز هذه الورقة البحثية أهمية عقد النشر كونه أحد أهم عقود الاستغلال، إذ يتيح للمؤلف إيصال مصنفه إلى الجمهور بشكل غير مباشر من خلال استنساخ نسخه وتوزيعها. وقد أولى المشرع الجزائري اهتمامًا خاصًا بهذا العقد منذ أول تشريع يتعلق بحقوق المؤلف، مرورًا بالقوانين اللاحقة، ولا سيما الأمر رقم 05/03 المؤرخ في 19 يوليو 2003، المتعلق بحقوق المؤلف والحقوق المجاورة. ويتميز عقد النشر بأحكامه المتعددة ومواده الغنية، مما يجعله النموذج الأبرز للعقود المرتبطة بحقوق المؤلف. Abstract: This research paper highlights the significance of the publishing contract as one of the most important exploitation contracts, enabling the author to make their work accessible to the public indirectly through reproduction and distribution. The Algerian legislator has given special attention to this contract since the first legislation on copyright, followed by subsequent laws, particularly Ordinance No. 05/03 of July 19, 2003, concerning copyright and related rights. The publishing contract is distinguished by its numerous provisions and rich legal framework, making it the predominant model among contracts related to copyright.
