استدراكات البَنَّاني على الزرقاني ومنهجه فيها كتاب الزكاة أنموذجا

الملخص

يعتبر شرح الزرقاني من أهم الشروح على مختصر خليل في المذهب المالكي، وقد اعتنى بهذا الشرح العلامة البَنَّاني، فكتب عليه حاشية شرح واستدرك فيها على الزرقاني ما وقع منه خطأ في نظره. وقد ارتأيت من خلال هذا المقال إلى التعريف بالشيخين، وبيان أهمية كتابيهما، كما عرجت فيه على بيان المراد من الاستدراك الفقهي، كما بينت المنهج المتبع من البَنَّاني في استدراكاته، من خلال دراسة بعض المسائل من كتاب الزكاة. وقد خلصت هذه الدراسة إلى مجموعة من النتائج أهمها: الشيخين الزرقاني والبَنَّاني، من كبار علماء المالكية في عصريهما؛ كتاب شرح الزرقاني مع حاشية البَنَّاني من الكتب المعتمدة في الفقه المالكي؛ الاستدراك الفقهي: هو تصحيح الخطأ، أو إكمال النقص، أو إزالة اللبس الواقع في كلام الفقيه، في نظر المستدرك من أجل الوصول إلى الصواب فيه؛ اعتمد البَنَّاني في استدراكاته على شرح الزرقاني أقوال العلماء المالكية المتقدمين عليه كما أنه كان يتحرى الدقة في توثيقها، ويرجح بينها ناصرا لقول ومضعفا لآخر. Al-Zarqani’s explanation is considered one of the most important commentaries on Mukhtasar Khalil in the Maliki school of thought. The scholar Al-Banani took great care of this explanation, so he wrote an explanatory footnote to it in which he corrected for Al-Zarqani any errors that occurred in his opinion. Through this article, I decided to introduce the two sheikhs and explain the importance of their books. I also mentioned what is meant by jurisprudential correction. I also explained the approach followed by Al-Bunani in his corrections by studying some issues from the book on zakat. This study concluded with a set of results, the most important of which are: Sheikhs Al-Zarqani and Al-Bannani, among the leading Maliki scholars of their era; The book Sharh al-Zarqani, along with Hashiyat al-Bunani, is one of the approved books in Maliki jurisprudence. Jurisprudential correction: It is correcting the error, completing the deficiency, or removing the ambiguity in the words of the jurist, in the eyes of the scholar, in order to reach the truth in it. In his arguments, Al-Banani relied on Al-Zarqani’s explanation of the sayings of the Maliki scholars who preceded him. He also sought accuracy in documenting them, weighing between them, supporting one view and weakening another.
