الملخص
الملخص: يتناول هذا المقال عرض نماذج لمنهج أصحاب الفكر الحداثي في تعاملهم مع مقاصد الشريعة الإسلامية، في توظيفهم لها في ردِّ بعض الأحكام الشرعية لكونها -بزعمهم- متعارضةً معها، ويتضمن المقال بعض ما طرحه الحداثيون في هذا الباب، ثم بيان بطلان ذلك من خلال بيان مراعاة الشريعة الإسلامية للمقاصد الشرعية، وضمانها للمصالح التي يحتاجها العباد، ومن خلال الجواب عن الشبهات المرتبطة ببعض المقاصد التي زعموا إهمال الشريعة الإسلامية لها. Abstract: This article presents examples of the approach of modern thinkers in their dealings with the objectives of Islamic law, in their use of it to reject some legal rulings because - as they claim - they conflict with them. The article includes some of what the hadith scholars have proposed in this section, and then shows the invalidity of that by explaining the observance of Sharia law. Islamic law provides for the purposes of the law, and its guarantee of the interests that people need, by answering the doubts related to some of the purposes that they claimed that Islamic law neglected.
